Privacy Policy

This Privacy Policy explains how American Trucking Compliance LLC (“American Trucking Compliance,” “ATC,” “we,” “us” or “our”) collects, uses, shares and protects personal information when you visit americantruckingcompliance.com (the “Site”), contact us, or use our mobile compliance services, including CARB Clean Truck Check testing, IRS Form 2290 e-filing, DMV registration, VIN verification, USDOT/MCS-150, UCR, Employer Pull Notice (EPN) and business filing services (the “Services”). By using the Site or Services, you agree to this Policy.
We are a private company, not a government agency. We are not affiliated with the California DMV, Nevada DMV, CARB, IRS, FMCSA or USDOT. When we submit information to those agencies on your behalf, the agency’s own privacy practices also apply to that information.
1. Information We Collect
Information you give us. When you request an appointment, contact us, join a waitlist, text or call us, or use our Services, we may collect:
- Contact details: name, company name, phone number, email address and mailing address.
- Vehicle information: VIN, license plate, make, model, year, gross vehicle weight, odometer reading, emissions and OBD test data, photos of the vehicle or VIN plate, and title and registration records.
- Business and regulatory information: USDOT and MC numbers, EIN, business entity details, fleet size, UCR and MCS-150 data, and driver information needed for EPN enrollment (such as driver name, date of birth and driver license number).
- Tax return information: information needed to prepare and e-file Form 2290 (such as EIN, taxable gross weight, first-use month and tax period).
- Identification and payment information: government ID when required by an agency for a transaction, and payment details. Card payments are processed by our payment processor. We do not store full card numbers on our Site.
- Location of service: the address or location where you want us to meet your vehicle.
Information collected automatically. When you visit the Site, we and our service providers may collect your IP address, browser and device type, pages viewed, referring pages, approximate location, and the date and time of your visit, using cookies, pixels and similar technologies (see Section 6).
Information from others. We may receive information from government agency systems in connection with a transaction you request, from referral partners, from fleet managers who schedule services for their drivers, and from public sources such as the FMCSA SAFER database.
2. How We Use Information
- To provide the Services you request, including testing, filing, registering and verifying vehicles and submitting information to government agencies on your behalf.
- To schedule, confirm and manage appointments, and to send reminders and compliance deadline notices.
- To communicate with you by phone, text message and email.
- To process payments and keep business, tax and transaction records.
- To operate, secure, analyze and improve the Site and our Services.
- To comply with legal, regulatory, licensing and recordkeeping obligations, including requirements of the California DMV, CARB and the IRS.
- To prevent fraud and protect the rights, property and safety of our customers, our company and others.
3. Tax Return Information
As an IRS Authorized e-file Provider, we use and disclose tax return information (such as your Form 2290 data) only to prepare and file your return and as permitted by federal law, including Section 7216 of the Internal Revenue Code and its regulations. We will not use or disclose your tax return information for any other purpose, including marketing, without your written consent where the law requires it.
4. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as follows:
- Government agencies such as the California DMV, CARB, the IRS, FMCSA/USDOT, the UCR program and the Nevada Secretary of State, as needed to complete the transactions you request.
- Service providers that help us run our business, such as website hosting, scheduling (for example, Calendly), email and text messaging, payment processing, IRS e-file transmission software, emissions testing equipment and reporting systems, cloud storage and analytics. They may use your information only to perform services for us.
- Your authorized contacts, such as a fleet manager, employer or other person you tell us to work with.
- Legal and safety reasons, when required by law, subpoena or court order, or to protect rights, property or safety.
- Business transfers, in connection with a merger, acquisition or sale of all or part of our business, subject to this Policy.
5. Text Messages (SMS)
If you give us your mobile number, you agree that we may text you about your appointments, requests, documents and compliance deadlines. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or text HELP for our contact information. Consent to receive texts is not a condition of purchase. We do not sell or share mobile numbers or text-messaging consent with third parties or affiliates for their marketing purposes.
6. Cookies, Analytics and Do Not Track
The Site uses cookies and similar technologies to operate the Site, remember preferences, cache pages for speed, and measure traffic. We use Google Analytics and Google Site Kit to understand how visitors use the Site. Google may use cookies and collect information according to its own privacy policy (policies.google.com/privacy). Pages that show a Google Map load content from Google. You can block or delete cookies in your browser settings, and you can opt out of Google Analytics with Google’s browser add-on (tools.google.com/dlpage/gaoptout).
Do Not Track. Our Site does not currently respond to browser “Do Not Track” signals. Third parties such as analytics providers may collect information about your online activity over time and across different websites when you use our Site.
7. Data Security and Retention
We use administrative, technical and physical safeguards designed to protect personal information, including limiting access to people who need it to perform the Services. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information such as full Social Security or card numbers through our website forms or by regular email. Call us and we will arrange a secure way to provide it.
We keep personal information for as long as needed to provide the Services and to meet legal, tax, licensing and recordkeeping requirements, then securely delete or de-identify it.
8. Your Choices and Rights
- Access and correction: you may ask to review or correct the personal information we hold about you by contacting us (Section 12). We may need to verify your identity first.
- Deletion: you may ask us to delete your information. Some records must be kept to meet legal, tax or licensing requirements.
- Marketing: you may opt out of marketing emails with the unsubscribe link, or stop texts by replying STOP. We will still send messages about services you request.
9. California Residents
Under the California Online Privacy Protection Act (CalOPPA), this Policy describes the categories of personal information we collect through the Site, the categories of third parties we share it with, how you can review and request changes to your information, how we notify you of changes to this Policy, and how we respond to Do Not Track signals. California residents may also ask us, once per calendar year, for information about any disclosure of personal information to third parties for their direct marketing purposes (California Civil Code §1798.83). We do not make those disclosures. To the extent the California Consumer Privacy Act (CCPA) applies to us, California residents may request to know, correct or delete their personal information, and we will not discriminate against you for exercising those rights. We do not sell or share personal information as those terms are defined by the CCPA.
10. Nevada Residents
We do not sell covered information as defined by Nevada law (NRS 603A). Nevada residents may still submit a request directing us not to sell their covered information by emailing Support@americantruckingcompliance.com with the subject line “Nevada Opt-Out Request.” We will respond within 60 days.
11. Children
Our Site and Services are intended for businesses and adults. We do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, please contact us and we will delete it.

13. Changes to This Policy
We may update this Policy from time to time. When we do, we will post the updated version on this page and change the “Effective” date above. If we make material changes, we may also notify you by email or by a notice on the Site. Your continued use of the Site or Services after an update means you accept the updated Policy.
